The agreements, policies, and guidelines that govern how we work together. Written in plain English.

Acceptance of Terms

By accessing or using any Skytona website (including skytona.com, portal.skytona.com, and app.skytona.com), applications, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. Together, these documents form the complete agreement between you and Skytona regarding your use of our services.

If you do not agree to these Terms, you must discontinue use of all Skytona websites and services immediately. We reserve the right to update these Terms at any time. When we make material changes, we will notify active clients through the Skytona Portal and update the "Last updated" date at the top of this page. Continued use of our services after changes are posted constitutes acceptance of those changes.

Important: These Terms apply to all visitors, users, and clients of Skytona. Individual service agreements (SOWs) may contain additional terms specific to your project. Where a SOW conflicts with these general Terms, the SOW takes precedence for that specific engagement.

Definitions

The following terms are used throughout this document. Understanding them will help you navigate these Terms clearly.

  • "Skytona" refers to Skytona, the company, including its team members, contractors, and authorized representatives.
  • "Client"(or "you") refers to any individual, couple, or business entity that engages Skytona for services, whether through a formal service agreement or by using the Skytona Platform.
  • "Services" refers to all offerings provided by Skytona, including but not limited to wedding film production, photography, business media retainers, content creation, website development, digital experiences, and platform access.
  • "Platform" refers to the Skytona web applications, including the marketing site (skytona.com), the Wedding Portal (portal.skytona.com), and the Business Portal (app.skytona.com).
  • "Deliverables" refers to the final output produced by Skytona for a Client, including films, photographs, edited content, websites, designs, and any other creative or technical work product.
  • "SOW" or "Service Agreement" refers to the specific contract between Skytona and a Client that outlines the scope, deliverables, timeline, pricing, and payment schedule for a particular project or engagement.
  • "Portal" refers to the client dashboard within the Skytona Platform where Clients access project information, planning tools, communication, deliverables, and payment tracking.
  • "Cinema Room" refers to the dedicated space within the Wedding Portal where wedding films are delivered, viewed, and shared. It is designed as a cinematic viewing experience for couples and their families.

Services Overview

Skytona is a premium media studio operating two distinct divisions, each built to deliver exceptional quality and a structured, transparent experience.

Skytona Weddings

Cinematic wedding films and photography for couples who value storytelling, craft, and a premium experience. Wedding services include:

  • Three packages: The Cut, The Feature, and The Premiere, each offering increasing levels of coverage, team size, and deliverables.
  • 8-Quest Planning System: A structured onboarding and planning process delivered through the Wedding Portal, guiding couples from booking through delivery.
  • Cinema Room Delivery: All wedding films are delivered through the Cinema Room, a curated viewing experience within your Portal.
  • Structured Release Model: Films are released in a deliberate sequence over the first year of marriage, designed to create meaningful moments of anticipation and celebration.

Skytona Business

Media production, content creation, and systems infrastructure for businesses that need consistent, high-quality output. Business services include:

  • Media production retainers (video, photo, and content on a recurring basis)
  • Content creation and social media management
  • Website development and digital experiences
  • CRM and systems setup, integration, and management

Platform access is part of the service. Every Skytona client receives access to their own Portal, where project management, communication, deliverables, and payments are centralized. The Platform is not a separate product; it is how Skytona operates.

Service Agreements

All Skytona projects are governed by an individual Service Agreement (SOW) that is specific to your engagement. The SOW is a binding contract between you and Skytona.

Each SOW specifies:

  • The scope of work and specific services to be provided
  • Deliverables, including format, quantity, and specifications
  • Project timeline and key milestones
  • Pricing and total project cost
  • Payment schedule and terms
  • Any additional terms specific to your project

No work begins until the SOW is signed and the initial payment is received. This protects both parties by ensuring there is a clear, mutual understanding of expectations before any resources are committed. Where the SOW conflicts with these general Terms of Service, the SOW takes precedence for that specific engagement.

Booking and Payment

Payment terms vary by service type. All payments are processed securely through our PCI-compliant payment processor. Specific pricing and payment schedules are detailed in your SOW.

Wedding Bookings

  • A 30% non-refundable deposit is required to secure your date. Your date is not held until the deposit is received.
  • Pay-in-full option: Clients who pay the full balance at the time of booking receive a 10% discount on the total package price.
  • Installment plans: Up to 6 monthly payments are available. The payment schedule will be outlined in your SOW.
  • Final balance must be paid in full before delivery of any Deliverables.

Business Retainers

  • Billed monthly at the rate specified in your SOW.
  • A 3-month minimum commitment is required for all retainer engagements. This allows adequate time to build momentum and demonstrate results.

One-Off Projects

  • 50% deposit due upon signing the SOW.
  • Remaining 50% due upon project completion, before final delivery.

Late payments: Invoices that remain unpaid for 30 or more days may result in paused services until the balance is resolved. Skytona will notify you before pausing any active work. We prefer to resolve payment issues through direct communication.

Cancellation and Rescheduling

Wedding Cancellations

Wedding deposits are non-refundable. This policy exists to protect the team's time, preparation, and the opportunity cost of holding your date (which prevents us from booking other events). In certain circumstances, deposits may be transferable to a new date, subject to availability and timing. Transferability is evaluated on a case-by-case basis.

Business Retainer Cancellations

After the 3-month minimum term, business retainers may be cancelled with 30 days of written notice. Notice must be submitted through the Business Portal or via email to your Skytona account manager. Services will continue through the end of the current billing period.

Cancellation by Skytona

If Skytona must cancel a project due to an emergency, force majeure, or circumstances beyond our control, you will receive a full refund of all unused fees. We will communicate promptly and work to minimize any disruption.

Rescheduling

Rescheduling is subject to team availability. If you reschedule 60 or more days before your event or project start date, there is no additional charge. Rescheduling requests made within 60 days may incur additional fees depending on the impact to scheduling and logistics. All rescheduling requests should be submitted through the Portal or directly to your Skytona point of contact.

Intellectual Property

Creative ownership and usage rights are important to both parties. Here is how intellectual property works at Skytona.

Your License

Upon full payment, you receive a perpetual, non-exclusive license to use the Deliverables for personal or business use as specified in your SOW. This means you can use your films, photos, and content freely within the scope outlined in your agreement.

Skytona's Ownership

Skytona retains full copyright and ownership of all creative work produced. This includes the right to use Deliverables for portfolio display, marketing materials, social media content, case studies, and other promotional purposes, unless you and Skytona have explicitly agreed otherwise in writing.

Raw Footage

All raw, unedited footage remains the exclusive property of Skytona. Raw footage is not included in standard packages. If you wish to purchase raw footage, it is available through The Vault add-on, which can be discussed with your Skytona team.

Restrictions

You may not resell, sublicense, or distribute Deliverables for commercial gain beyond your own personal or business use without Skytona's written permission. For example, you may share your wedding film with family and on social media, but you may not license it to a third party or use it in a commercial product.

In plain terms: You own the right to use your content. We own the right to show our work. If you need expanded usage rights, just let us know and we will work it out in your SOW.

Deliverables and Release Timeline

Wedding Films: Structured Release Model

Wedding films follow a deliberate release schedule designed to extend the joy and anticipation of your wedding story across your first year of marriage:

  1. Trailer (approximately 3 months after your wedding): A cinematic preview of your film, perfect for sharing.
  2. Feature Film (approximately 6 months after your wedding): The complete, edited wedding film.
  3. Anniversary Clips (approximately 1 year after your wedding): Individual ceremony, dance, and speech films delivered around your first anniversary.

Earlier delivery is available as a Change Request and may include a rush fee of $1,999. Rush requests are evaluated based on current production capacity.

Business Deliverables

Timelines for business deliverables are specified in your SOW. Retainer clients typically receive deliverables on a monthly cycle, with specific milestones and review periods documented in the agreement.

Delivery Method

All Deliverables are delivered through the Skytona Portal. Wedding films are presented in the Cinema Room, a curated, cinematic viewing experience built into your dashboard. Business deliverables are accessible through the Business Portal with full tracking and version history.

Accessibility: Deliverables remain accessible in your Portal for the duration specified in your service agreement. We recommend downloading and backing up your files for long-term safekeeping.

Revisions and Change Requests

Wedding Film Revisions

All wedding packages include 1 round of revisions. To make the most of your revision round, please submit a single, consolidated list of notes rather than sending feedback in multiple messages. This ensures nothing gets lost and allows our editors to address everything in one pass.

Major structural changes requested after delivery (such as re-editing the entire narrative, adding significant new content, or changing the overall direction of the film) constitute a Change Request and may incur additional fees.

Business Deliverable Revisions

The revision allowance for business projects is specified in your SOW. Retainer clients typically have a defined number of revision rounds per deliverable within each monthly cycle.

What Triggers a Change Request

The following situations are considered Change Requests rather than standard revisions:

  • Requesting new deliverables not included in the original SOW
  • Adding locations or shoot days beyond the agreed scope
  • Requesting earlier deadlines than originally scheduled
  • Significant shifts in audience, direction, or creative vision
  • Expanded usage rights beyond what was originally licensed
  • Any work that falls outside the defined scope of your agreement

Change Request Process

  1. Submit a written request through the Portal or to your Skytona contact.
  2. Skytona will provide an impact assessment, including timeline and cost implications.
  3. Written approval is required before any Change Request work begins.
  4. Additional fees, if applicable, will be documented and agreed upon in writing.

Flagship Rule:The primary Skytona wedding film must meet Skytona's creative standards for pacing, tone, and craft. This is the film that represents both your story and our work. If you want alternate styles (trending formats, social media edits, or other creative directions), those are available as separate add-on deliverables. The flagship film is always held to the highest standard.

Client Portal

Portal usage is mandatory. The Skytona Portal is how we deliver a premium, organized experience. All communication, planning, file delivery, and payment tracking happen through the Portal. This is not optional; it is a core part of the Skytona service.

Your Portal provides:

  • Project dashboard with real-time status updates
  • Planning tools and timeline management
  • Centralized communication with your Skytona team
  • Secure file delivery and downloads
  • Payment tracking and invoice history

Wedding Portal (portal.skytona.com)

Wedding clients receive access to:

  • 8-Quest Planning System: A guided, step-by-step process covering everything from mood and vision to logistics and final details.
  • Cinema Room: Where your wedding films are delivered and viewed in a curated cinematic experience.
  • Timeline management, gallery access, and team coordination tools.

Business Portal (app.skytona.com)

Business clients receive access to:

  • Deliverable tracking with version history and approval workflows
  • Analytics and performance reports
  • Contract management and documentation
  • Direct communication with your Skytona team

You are responsible for providing accurate, timely information through the Portal. Delays in providing requested information may impact project timelines.

SMS and Text Communications

By opting in to SMS communications through any Skytona form, you consent to receive text messages from Skytona at the phone number you provided. SMS messages are sent from +1 (207) 747-3366. Consent to receive text messages is not a condition of purchasing any goods or services.

Message Types

Text messages from Skytona may include: project updates, booking confirmations, scheduling reminders, delivery notifications, and direct responses to your inquiries.

Message Frequency

Message frequency varies. During active projects, you may receive 1 to 5 messages per month. Outside of active engagements, you will not receive messages unless you initiate contact.

Message and Data Rates

Message and data rates may apply.

Opting Out

You may opt out at any time by replying STOP, UNSUBSCRIBE, END, QUIT, or CANCEL to any message from Skytona. Once you opt out, you will not receive further text messages unless you re-subscribe.

Help

Reply HELP to any message for support information, or email support@skytona.com.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Carriers are not liable for any delayed or undelivered messages.

Client Conduct

Skytona maintains a professional, respectful working environment. We hold ourselves to a high standard, and we expect the same from those we work with.

Professional Environment

Abusive, threatening, discriminatory, or persistently disrespectful behavior toward any Skytona team member (including staff, contractors, and partners) will not be tolerated. Our process is as follows:

  1. First incident: A formal warning will be issued, and the behavior will be documented.
  2. Second incident: Skytona reserves the right to terminate the agreement. In the event of termination due to conduct, refund terms will be determined based on work completed to date.

Working Conditions

The Client is responsible for ensuring that Skytona team members have safe, reasonable working conditions at any event, location, or venue. This includes adequate access to the spaces needed for production, reasonable break times, and a physically safe environment.

Creative Authority

Requests from third parties (such as parents, wedding planners, or business partners) do not override Skytona's creative process unless those requests are explicitly documented in the SOW. Creative direction flows through the Client and the signed agreement, not through outside parties during production.

Limitation of Liability

Skytona guarantees professional execution quality and a structured, transparent process. We do not guarantee specific subjective outcomes, as creative work involves collaboration and inherent variability.

Maximum Liability

Skytona's total liability for any claim arising from a project is limited to the total fees paid by the Client for that specific project. This cap applies regardless of the nature of the claim, whether based in contract, tort, negligence, or otherwise.

Exclusions

Skytona is not liable for issues caused by:

  • Equipment failures that are beyond reasonable control despite proper preparation
  • Acts of God, natural disasters, pandemics, or other force majeure events
  • Venue or vendor actions, restrictions, or failures
  • Weather conditions or environmental factors beyond our control
  • Any circumstances outside of Skytona's reasonable production control, including power outages, venue policy changes, or emergency evacuations

Our commitment: If something goes wrong within our scope of responsibility, we will work diligently to resolve it. Our satisfaction process operates within the boundaries of scope, ethics, and creative standards. We do not make promises we cannot keep, and we stand behind the work we deliver.

Indemnification

You agree to indemnify, defend, and hold harmless Skytona, its team members, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of Deliverables beyond the scope of the license granted in your SOW or these Terms.
  • Inaccurate, misleading, or incomplete information provided by you to Skytona during the course of a project.
  • Your violation of any applicable law, regulation, or third-party right in connection with your use of Skytona's services or Deliverables.

This indemnification obligation survives the termination or expiration of your service agreement.

Confidentiality

Skytona takes the privacy and confidentiality of client information seriously. Our default position is always privacy.

Client Media and Information

All client media, personal information, project details, and business data shared with Skytona are treated as confidential. We will not share, publish, or distribute sensitive content without your explicit written permission.

Portfolio and Promotional Use

As noted in the Intellectual Property section, Skytona retains the right to use Deliverables for portfolio and promotional purposes. However, we will always ask before sharing content that includes sensitive, private, or personal moments beyond what is typical for portfolio use. If you have specific privacy requirements, we can document them in your SOW.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions.

Dispute Resolution

In the event of a dispute arising from these Terms or any Skytona service, both parties agree to the following process:

  1. Good-faith negotiation: Both parties will first attempt to resolve the dispute through direct, good-faith communication. Most issues can be resolved through honest conversation.
  2. Binding arbitration: If direct negotiation does not resolve the dispute within 30 days, both parties agree to submit the dispute to binding arbitration conducted in the State of Maine, in accordance with applicable arbitration rules. The decision of the arbitrator shall be final and binding.

Both parties agree that any arbitration will be conducted on an individual basis, not as part of a class or consolidated action. Each party is responsible for its own legal costs, unless the arbitrator determines otherwise.
